EVONOTE is built on trust. Your journal entries and notes are deeply personal, and we take that responsibility seriously. We will never sell your journal content, use it for advertising or AI training, or share it with anyone beyond what's necessary to operate the service (database storage, authentication, and hosting infrastructure).
Welcome to EVONOTE. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By creating an account or using EVONOTE, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the service.
2. Description of Service
EVONOTE provides a digital journaling platform where users can create, edit, and store journal entries. The service is provided on an "as-is" and "as-available" basis.
3. Service Availability
We strive to provide reliable service, however, EVONOTE is operated by an individual developer and makes no guarantees regarding:
- Continuous or uninterrupted access to the service
- The absence of errors, bugs, or technical issues
- Specific uptime percentages or service availability metrics
- Immediate resolution of service disruptions
The service may be temporarily unavailable due to maintenance, updates, third-party service outages, or unforeseen technical issues.
4. Data Storage and Backup
While we make reasonable efforts to maintain your data, we do not guarantee:
- Permanent storage or backup of your journal entries or user data
- Recovery of lost or corrupted data
- Protection against all forms of data loss
You are solely responsible for maintaining your own backups of any important content. We strongly recommend regularly exporting and backing up your journal entries independently.
5. User Responsibilities
You agree to:
- Provide accurate information during account registration and maintain the security of your account credentials
- Use the service in compliance with all applicable laws
- Not use the service for any unlawful, harmful, or abusive purposes
- Not attempt to gain unauthorized access to any part of the service
- Maintain your own backups of important content
6. Our Commitment to Your Data
Your privacy is paramount. Here's our promise about your journal content:
- ✓We will never sell your journal entries or notes. Not to advertisers, not to third parties, not to anyone. Your writing is yours alone.
- ✓We will never use your journal content for our benefit. We don't read, analyze, or train AI models on your entries. We don't mine them for insights, advertising, or any other purpose beyond providing you the service.
- ✓We only share what's necessary. Your journal content is only accessible to the essential infrastructure services (Clerk, Neon, Vercel) required to operate EVONOTE. These are industry-standard, trusted providers with their own strict privacy commitments.
- ✓Your journal content is for storage only. We exist to provide you a safe, private space to write. That's it.
This isn't just a legal statement—it's the foundation of what EVONOTE is built on. Note: Standard technical and usage data (like login times, features used) may be collected to operate and improve the service, but your actual journal entries and notes remain completely private.
7. Third-Party Services
EVONOTE uses third-party services including but not limited to:
- Clerk for authentication and user management
- Neon for database hosting
- Vercel for application hosting and deployment
These services are subject to their own terms of service and privacy policies. Service disruptions or data issues at these third-party providers may affect EVONOTE's availability or functionality. We are not responsible for the performance, security, or availability of third-party services.
8. Limitation of Liability
To the maximum extent permitted by law, EVONOTE and its operator shall not be liable for:
- Any loss of data, content, or information stored in the service
- Any service interruptions, downtime, or unavailability
- Any indirect, incidental, special, consequential, or punitive damages
- Any damages arising from the use or inability to use the service
- Any security breaches or unauthorized access to user data
- Any errors, bugs, or technical issues in the service
In no event shall our total liability to you for all damages exceed the amount you paid to use the service in the past twelve months, or $100, whichever is less.
9. No Warranties
The service is provided "as-is" without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of data accuracy or completeness
- Warranties of uninterrupted or error-free service
- Warranties regarding security or data protection
10. Account Termination
We reserve the right to suspend or terminate your account at any time, for any reason, including but not limited to:
- Violation of these Terms
- Suspected fraudulent or abusive behavior
- Extended periods of inactivity
- Discontinuation of the service
Upon termination, you may lose access to your account and all associated data.
11. Service Modifications and Discontinuation
We reserve the right to modify, suspend, or discontinue the service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.
12. Indemnification
You agree to indemnify, defend, and hold harmless EVONOTE and its operator from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service or violation of these Terms.
13. Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:
- Acts of God, natural disasters, or extreme weather events
- War, terrorism, civil unrest, or government action
- Internet service provider failures or cyber attacks
- Third-party service outages (Clerk, Neon, Vercel, or others)
- Power failures, hardware failures, or network issues
- Pandemics, epidemics, or public health emergencies
- Labor disputes or strikes
During such events, our obligations under these Terms will be suspended for the duration of the force majeure event.
14. Changes to Terms
We reserve the right to modify, update, or replace these Terms at any time, with or without notice, for any reason, including but not limited to legal, operational, or business reasons. Changes will be effective immediately upon posting to the service.
Your continued use of the service after any changes constitutes your acceptance of the updated Terms. It is your sole responsibility to review these Terms periodically. We are under no obligation to notify you of changes.

15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the service operator resides, without regard to conflict of law principles.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms constitute the entire agreement between you and EVONOTE regarding the use of the service and supersede any prior agreements.
18. Dispute Resolution and Class Action Waiver
Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration on an individual basis.
YOU AGREE TO WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION. All disputes must be brought individually.
Some jurisdictions do not allow certain limitations, so some of the above limitations may not apply to you.
19. Beta Features and Experimental Services
EVONOTE may offer beta, experimental, or preview features from time to time. These features are provided "as-is" with no warranties and may be modified or discontinued at any time without notice. We are not liable for any issues arising from your use of beta features.
20. Export Restrictions
You agree to comply with all applicable export and import laws and regulations. You may not use the service if you are located in a country subject to embargo or if you are on any government list of prohibited or restricted parties.
21. Intellectual Property
You retain all ownership rights to your journal entries and content. By using EVONOTE, you grant us a limited license to store, display, and transmit your content solely for the purpose of providing the service to you.
All other content, features, and functionality of EVONOTE (including but not limited to software, design, text, graphics, and logos) are owned by EVONOTE and protected by copyright, trademark, and other intellectual property laws.
